More than one and a half lakh applications received in four months in UCC in Uttarakhand: CM Dhami

Chief Minister Shri Pushkar Singh Dhami participated in the meeting of the Council of Chief Ministers held in New Delhi under the chairmanship of Prime Minister Shri Narendra Modi. Giving a presentation on the Uniform Civil Code implemented in Uttarakhand, the Chief Minister said that a strong system has been created to implement UCC. A portal and dedicated mobile app have also been developed to make the process more accessible and easy for the general public. Also, more than 14,000 Common Service Centers (CSC) have been linked to it at the village level.

The Chief Minister informed that Auto Escalation and Grievance Redressal System has also been implemented to overcome the problems faced at the time of registration. As a result of extensive digital and physical networking, more than one and a half lakh applications have been received from across the state under the Uniform Civil Code in a period of just four months. Not only this, applications have been received from about 98 percent of the villages of the state, which shows that UCC is getting full support of the public.

The Chief Minister thanked Prime Minister Shri Narendra Modi and Union Home Minister Shri Amit Shah for their guidance and cooperation in successfully implementing the UCC and said that under the leadership and guidance of the Prime Minister, in the 2022 assembly elections, through his vision document, he had promised the people of the state that if the mandate was received, the Uniform Civil Code would be implemented in Uttarakhand. After the victory in the elections, from the very first day, he started his work to implement the UCC in Uttarakhand. A committee was constituted under the chairmanship of Justice Ranjana Desai on 27 May 2022 to draft the UCC bill. Extensive public consultation was done by the committee in all 13 districts of Uttarakhand.

Through which the committee received about 2 lakh 32 thousand suggestions. The committee not only consulted the common citizens but also interacted with all the political parties and the heads of various statutory commissions.

The state government passed the Uniform Civil Code Bill in the State Assembly on February 7, 2024 and sent it to the Hon. President. Hon. President gave her assent to this historic bill on March 11, 2024. Completing the necessary rules and procedures, the Uniform Civil Code was duly implemented in the entire state of Uttarakhand on January 27, 2025. Thus, Uttarakhand became the first state in the country to implement the Uniform Civil Code on the practical level, giving concrete form to the spirit of Article 44 of the Constitution.

Giving information, the Chief Minister said that the Uniform Civil Code is a constitutional measure to eliminate discrimination in legal matters on the basis of differences in caste, religion, gender etc.

Through this, an attempt has been made to give equal rights to all citizens. With its implementation, women empowerment will be ensured in the true sense in the state. Through this, now the evil practices like Halala, Iddat, Polygamy, Child Marriage, Triple Talaq etc. can be completely stopped.

Our scheduled tribes mentioned under Article 342 of the Constitution have been kept out of this code, so that those tribes and their customs can be protected.

Uniform Civil Code is not against any religion or sect, but it is a legal effort to establish harmony among all citizens by eradicating the evil practices of the society. This was also envisioned by our Constitution makers and included it in the Directive Principles of State Policy.

The basic beliefs and practices of any religion have not been changed through UCC, only the evil practices have been removed. Under UCC, a uniform legal process has been prescribed for citizens of all religions in matters related to marriage, divorce and inheritance. Now it will be mandatory for the husband and wife to follow the prescribed judicial procedure for divorce and the practice of polygamy has been completely banned.

Under these laws, daughters have been given equal property rights in all religions and communities. Along with this, no discrimination has been made among children in property rights, that is, children born on the basis of natural relations, assisted methods or live-in relationships will also be considered to have equal property rights. Under the UCC, parents have also been given rights in the property of children, so that the financial security of the elderly can be ensured and they get the right to live a respectable life.

Keeping in mind the current situation, in order to ensure the safety of the young generation, especially young men and women, and to protect them from possible social complications and crimes, registration for live-in relationships has been made mandatory. The registrar will give information about the couple registering to their parents or guardians, this information will be kept completely confidential. Like the registration of birth and death, both marriage and divorce can also be registered through UCC. Along with the implementation of the Uniform Civil Code, an effective and clear rule book has also been implemented for its implementation.
