GUIDELINES FOR RENTING OUT PROPERTY TO FOREIGNERS

Persons renting out their property to foreigners for accomodation must report the stay of a foreign national to a the FRRO

Maintain register of foreign national tenants for inspection by authorities in the prescribed format

It has been observed that on several occasions, while renting their property to foreign nationals, the property owners/administrators/managers fail to share information of the stay of foreigner guests with Foreigners Regional Registration Office (FRRO). As per the provisions of Foreigners Act, read with Foreigners (Amendment) Order, 2016 and Foreigners (Amendment) Rules, 2016, it is mandatory for a Hotel Keeper/property owner/ administrator/manager to inform FRRO about the foreign national staying in their premises, within 24 hours of arrival. The said information can be submitted by filling Form ‘C’ either online (https://indianfrro.gov.in) or offline, by visiting the office of the FRRO. A copy of the Form ‘C’ is annexed.

Accordingly, every person who is renting out property to a foreigner is required to maintain a register as per the prescribed format of Form ‘B’ (annexed) and the same is to be produced for inspection on demand by any Registration Officer, Magistrate or a police officer not below the rank of a Head Constable.

Further, it is also obligatory on part of the propery owner/administrator/manager to get their foreign national tenants verified for their antecedents, by submitting their details with their local police station.

Delhi Police solicits cooperation from all Hotel Keepers/property owners/administators/managers in complying with the rules and regulations, for the safety and security of theNational Capital. Noncompliance of the rules and regulations may invite the legal consequences.

Non compliance with law can invite legal consequences.
